Terms of Use and Conditions of Sale

1. Purpose

These General Conditions, updated in April 2025, together with the order form and other elements referred therein, are intended to regulate the terms and conditions governing the provision of the Online Store Service (vinigandra.com) by Vinigandra Comércio de Bebidas Lda. (hereinafter referred to as Vinigandra), with headquarters at Rua Dom Afonso Henriques 4340, 4445-641 Porto, with company identification number 509310290.

 

2. Terms of use and acceptance

2.1. By browsing this website, the User agrees to be bound by and accept the Terms of Use and Conditions of Sale;

2.2. Vinigandra maintains this website for individual use, in countries and other territories where the consumption of alcoholic beverages is legal, for people who are legally permitted to consume alcoholic beverages.

2.3. The User of this website must leave it immediately if they:

  • Do not accept the Terms of Use and Conditions of Sale.

  • Are not of legal drinking age in their country and/or other territory where they are located.

  • Are in a country or other territory where the use and/or access to this website is not permitted.

2.4. The User undertakes to use this website in compliance with applicable law, refraining from using the page for activities contrary to law, morals and good customs, or that are detrimental to the rights and interests of third parties;

2.5. Vinigandra assumes no responsibility for the content or privacy practices and data processing of any other websites that are not this one and to which this website may link; as such, you should read the terms of use and privacy policies of those websites.

 

3. Intellectual property

3.1. All text, visual, sound, technological and other content present on the website www.vinigandra.com are the exclusive property of Vinigandra and are protected by Intellectual Property Law. By allowing access to the website, Vinigandra is not granting any license or rights to the user;

3.2. No part of the website may be reproduced for commercialization or distributed for commercial purposes, so the use, reproduction, copying and dissemination by other means of logos, texts, images and videos contained on this website is always subject to prior authorization from Vinigandra.

 

4. Product Information, Prices and Content

4.1. Vinigandra reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.

4.2. The images illustrating each product at Vinigandra may differ from the product subsequently delivered, and these same products are also subject to stock rupture. In the event of temporary or definitive stock rupture, the customer will be informed and, whenever possible, an alternative of products with similar characteristics will be indicated.

4.3. Despite Vinigandra's efforts, some products in the online store may show an inaccurate price, which is why all values are verified before processing orders. Thus, the prices presented at Vinigandra are merely indicative and do not constitute a contractual proposal. If the effective price of the product is lower than the advertised price, Vinigandra will refund the difference. If the price is higher, Vinigandra will inform the customer of this situation by email and await their decision to accept the new price or cancel the order within 15 days from the date the email was sent.

4.4. Under Portuguese law, all prices shown at Vinigandra include the respective VAT rates in force, unless otherwise stated.

4.5. If the customer's needs cannot be met, the payment already made will be fully refunded without any additional cost to the customer;

4.6. The prices of all products indicated on our website are presented in euros, including price, transport, fees and taxes, all duly itemized;

4.7. Under Portuguese law, commercialized products are subject to legal tax rates, so the prices presented in Vinigandra's online store already include the respective VAT and other applicable taxes;

4.8. Shipping and transport service costs are borne by the buyer and are added to the total value of the selected products; the user will be informed of these charges before confirming their order and completing the purchase process;

4.9. If, when formalizing the order, a computer, manual, technical or any other error occurs, which causes a substantial alteration – understood as the communicated price proving to be disproportionate, being exorbitant or clearly derisory – and involuntary on the part of Vinigandra in the retail price, the purchase order will be considered invalid and cancelled.

 

5. Order and Payment

5.1. After confirming the order at Vinigandra, an email will be sent to the contact address registered by the customer when formalizing the order, with all details about delivery, invoicing, payment information, products and values. Vinigandra suggests all customers confirm the details of their order. If the customer does not receive the order confirmation email, they are asked to contact Vinigandra through the contacts available on the vinigandra.com website, so that this notification can be resent to the customer's email address.

5.2. If any of the details provided by the customer in the order are incorrect and/or the customer wishes to change any information, provided the order has not yet been dispatched, the customer is requested to contact Vinigandra through the contacts available on the vinigandra.com website as soon as possible so that the requested change can be made internally. Changes to details of already dispatched orders will have to be analyzed by the Vinigandra team so that the most suitable solution can be found together with the customer.

5.3. All orders at Vinigandra will only be processed after effective payment receipt. The formalization of the order itself does not constitute a reservation of the products.

5.4. If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Vinigandra to find the most suitable solution.

5.5. All orders placed at Vinigandra have a maximum payment period of 1 day. After this period, the order will be automatically cancelled.

5.6. Orders may be cancelled when expressly requested by the customer through the contacts available on the vinigandra.com website, before orders are dispatched. After confirmation of order dispatch, the customer is requested to contact Vinigandra so that the most suitable solution can be found together with them.

5.7. Through the Vinigandra Online Store, payments are accepted via Multibanco Reference (only for customers with a bank account in Portugal), Paypal, Credit Card and MB Way.

5.9. Payments are received in euros, regardless of the currency in which the transaction is made; costs associated with conversion fees for payments made in other currencies will be borne by the customer.

 

6. Shipping costs

To the prices presented for the products, the respective shipping cost is added to each order, which is calculated based on the transport cost. The transport cost depends on the weight of the order and its respective delivery destination. This shipping cost can be simulated in the shopping cart with the desired products added and by filling in all the requested fields of the simulator. The total shipping cost will also be automatically calculated when placing your order in the Online Store. It should be noted that the factors for this calculation may vary and undergo changes without prior notice.

 

7. Shipments and Deliveries/Pickup at Vinigandra warehouse

7.1. For orders to be sent to the requested address, the shipping option must be chosen – National Shipping (in the case of Portugal) and International Shipping (in the case of other countries outside Portugal).

7.2. In general, after dispatch, an order from Vinigandra takes to be delivered:

  • 72 hours in mainland Portugal;
  • Between 5 to 9 working days in Madeira and Azores Islands;
  • Approximately 4 working days in Peninsular Spain;
  • Approximately 6 working days in the rest of Europe;
  • Approximately 7 working days in the rest of the world.

7.3. After orders are dispatched, monitoring information will be available in the account of customers who have placed a registered order, and an email notification with the link for shipment monitoring is also sent to all registered and unregistered customers. If, for any reason, the customer does not receive the dispatch confirmation, they are requested to contact Vinigandra through one of the contacts available on the vinigandra.com website so that all available information about the order's dispatch can be resent.

7.4. After the dispatch notification, customers should follow the status of the shipment through the link provided by Vinigandra, so that they are aware of the progress until the moment of order delivery, as Vinigandra does not notify every change in shipment status.

7.5. All products sent by Vinigandra must be checked upon delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier's waybill, and immediately notify Vinigandra through one of the contacts available on the vinigandra.com website.

7.6. Vinigandra is not responsible for shipments made to countries where the respective law does not permit the entry of alcoholic beverages. Customers are responsible for any seizure of their orders, as well as the payment of customs duties, if applicable. In case of product return, Vinigandra will only refund the amount related to these products. In case of doubt, the customer may contact Vinigandra before ordering.

7.7. Vinigandra has contracted services with specialized carriers for deliveries in Portugal, Europe and most countries worldwide. Every effort is made to meet dispatch and delivery deadlines, however, it should be noted that possible delays in deliveries may be beyond Vinigandra's control, and in such cases, exact delivery times cannot be guaranteed.

7.8. Most deliveries are made during business hours on working days to the shipping address indicated by the customer when placing the order.

7.9. In case of an unsuccessful delivery attempt by the transport company due to absence, a delivery notice is always left in the customer's mailbox with the carrier's instructions. Depending on the service and the carrier, orders should be collected at the location indicated on the delivery notice, or the instructions requested on the same notice should be followed.

7.10. If for any reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact Vinigandra so that the most suitable solution can be found together.

 

8. Returns

8.1. Vinigandra recognizes all its customers' right to terminate contracts concluded with it, allowing them to return, within 14 (fourteen) days, products purchased under the terms of Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/05.

8.2. To request an exchange or return, the customer is requested to contact Vinigandra via email vinigandraonline@gmail.com, indicating the order number or the document number that accompanied the order, taking into account the conditions described below in the following points:

a) To return the order, the product must be in perfect condition, and if applicable, with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.

b) The return of defective products and mistaken shipments will be accepted, with Vinigandra being responsible for shipping and collection costs, provided the customer communicates this circumstance within 14 (fourteen) days from the date of receipt of the product.

c) Once the merchandise is received at our facilities and after verifying its condition in conformity, its value will be refunded according to the payment method made by the customer, or another solution previously agreed with them.

8.3. Vinigandra assumes responsibility for defects in origin or raw material of the purchased product and if such is confirmed by Vinigandra's specialized team, the product will be exchanged or returned without any cost to the customer.

8.4. Vinigandra will not accept the return of the product after it has been used, or if it has been altered or modified.

8.5. Vinigandra is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or force majeure.

8.6. For exchanges or returns, an email must be sent beforehand to vinigandraonline@gmail.com to inform of the fact and the underlying reason for the exchange or return, indicating the order number;

8.7. If the customer does not follow the instructions provided herein, Vinigandra may refuse to accept the product exchange or its return and, in the latter case, proceed with the corresponding refund.

10. Applicable Law

10.1. All purchases made on the Vinigandra website are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Online Sales Conditions will be submitted to the competent Portuguese Court.

10.2. If the Customer is outside mainland Portugal, Vinigandra hereby informs that any legal proceedings must be exclusively initiated in Portuguese Courts.
